These Terms govern your use of Noseprint (the “Service”), operated by Noseprint (the “Operator”, contact details below). By using the Service, you agree to these Terms.
1. What the Service does
Noseprint analyses a photograph you upload, together with three short questions, and returns an aesthetic “scent identity” archetype, three fragrance recommendations, and a shareable image card. The Service is for entertainment. It is not a medical, dermatological, or biometric assessment, and the recommendations are not professional advice. You must be at least 16 years old to use the Service.
2. Access & affiliate links
Viewing the full reading — archetype, trait composition, three fragrance recommendations, and the share card — requires an active Premium subscription. See section 3 below for details. Fragrance recommendations include affiliate links to third-party retailers (currently Notino and Amazon). When you purchase via these links the Operator may receive a commission at no additional cost to you. The presence or amount of any commission does not influence which fragrances are recommended.
3. Premium subscription
The Service offers a Premium subscription with two billing options:
- Annual: €29.99 per year (or USD equivalent). Includes a 3-day free trial. After the trial you will be charged €29.99 and then automatically renewed each year until you cancel.
- Weekly: €3.99 per week (or USD equivalent). No trial; charged immediately and renewed each week until you cancel.
Prices are shown inclusive of any applicable VAT. Currency is detected from your Stripe billing address. Premium unlocks unlimited scent analyses, deep-analysis content on each result, seven fragrance recommendations, and a celebrity scent twin feature.
Web payments are processed by Stripe and may be temporarily unavailable while the Operator completes commercial registration in connection with a relocation. iOS payments are processed by Apple under the Apple Media Services Terms of Use and are not affected.
4. Cancellation
You may cancel your Premium subscription at any time from your Stripe customer portal (linked from the result page once subscribed) or by emailing the Operator at the address below. Cancellation takes effect at the end of the current billing period; you continue to have access to Premium until that date. The Operator does not issue pro-rated refunds for partial billing periods.
5. Right of withdrawal & immediate access waiver
As a consumer in the European Union you have a 14-day right of withdrawal under Directive 2011/83/EU (in Germany: § 355 BGB) for contracts concluded at a distance. However, for digital content and digital services that are supplied immediately and not on a tangible medium, this right may be lost where you expressly consent to immediate performance and acknowledge that you thereby lose your right of withdrawal (Art. 16(m) of the Directive; § 356 (5) BGB).
By starting your Premium subscription you expressly request that the Premium service be made available immediately upon confirmation of payment (or, for the annual plan, upon activation of the 3-day trial), and you acknowledge that, once the Premium service has been fully provided to you, your right of withdrawal under § 355 BGB / Art. 9 of the Directive ceases to apply. This does not affect your right to cancel future renewals at any time under section 4.
Plain-language summary: you can cancel at any time and you will not be charged for future billing periods, but you cannot reclaim payment for a billing period during which you used the Premium service.
6. Acceptable use
You agree not to upload (a) photographs of any person under 16 or who has not consented to your upload, (b) photographs you do not have the right to use, or (c) content that violates any applicable law. The Operator may refuse the Service or terminate your access for misuse.
7. Disclaimer & liability
The Service is provided “as is”. To the maximum extent permitted by law, the Operator excludes all warranties of merchantability, fitness for a particular purpose, or accuracy of recommendations. The Operator’s liability for any claim arising from the Service is limited to the amount you paid the Operator in the 12 months before the claim. Statutory rights that cannot be excluded under EU consumer law are unaffected. Liability for intent and gross negligence, and for injury to life, body, or health, is unlimited.
8. Privacy
Your selfie is processed in memory and never stored. See our Privacy page for full details, including your rights under GDPR.
9. Changes
The Operator may update these Terms. The current version is always accessible at this URL with the “Last updated” date above. If a change materially affects your subscription, you will be notified by email before the change takes effect and you may cancel without penalty before the change applies.
10. Governing law & venue
These Terms are governed by the law of the Federal Republic of Germany once the Operator is resident in Germany. Until then they are governed by the law of the Netherlands. In either case, mandatory consumer-protection provisions of your country of habitual residence (within the EU) remain unaffected. The exclusive venue for disputes arising from these Terms, where permitted by law, is the Operator’s place of residence.
11. EU online dispute resolution
The European Commission provides an online dispute resolution platform at ec.europa.eu/consumers/odr. The Operator is not obligated and not willing to participate in dispute-resolution proceedings before a consumer arbitration board.
